Lundgrens assists Cutters AS with trademark registration of CUTTERS

Cutters AS is a unique drop-in concept of hair salons based on efficient, high-quality haircut and styling within 15 minutes at a fixed price. Cutters have opened salons in Norway, Sweden and Denmark and are rapidly expanding.

Cutters AS filed for EU trademark registration of the word mark CUTTERS, which application was initially refused by the examiner of the European Union Intellectual Property Office (EUIPO). On behalf of Cutters AS, Lundgrens appealed the refusal to the EUIPO Board of Appeal.

Lundgrens successfully argued that the examiner had misinterpreted the EU trademark regulation, that CUTTERS did not lack distinctive character for the services offered and that the trademark would be perceived as an indication of commercial origin.

By decision of 12 November 2018, the EUIPO Board of Appeal annulled the refusal and referred the case back to the EUIPO examiner. As a result, the CUTTERS trademark obtained registration in the EU as of 12 April 2019.
