According to the new act, employers will be required to draft a written policy on whether and if so how the employees are allowed to use e-cigarettes at the company’s premises. It may be a good idea to incorporate the e-cigarette policy into the company’s existing smoking policy. Employers will also be required to ensure compliance with the e-cigarette policy at the company's premises. The Danish Working Environment Authority will supervise compliance with the rules, as is the case with the Danish Smoke-free Environment Act. This means that if an employer fails to implement an e-cigarette policy, the Danish Working Environment Authority will be entitled to issue an enforcement notice. The new E-cigarettes Act will take effect on 7 June 2016.
