Legal advise about ESG in transactions
We assist our clients with ESG due diligence investigations, either to ensure regulatory compliance or compliance with the buyer's own EGS standards. This contributes to risk hedging.
We assist on drafting purchase agreements that contain representation and warranties regarding ESG as well as any obligations to fulfill the buyer's ESG requirements either before or after a closing. The buyer may as an example require sustainability certifications, which we can describe or help to achieve.
In transactions, we also advise on the regulatory environment for sustainable finance as a fully or partially sustainable financial product for the acquisition financing.
