Legal advise about green marketing
With the increased awareness of sustainability among consumers, it has become an important criterion in their purchase consideration. Many consumers are even willing to pay more for a product if the product is sustainable.
If a company's products are less harmful to the climate and the environment than other products, or if the company makes an extra effort for the environment, these are obviously important messages to convey in marketing. Such marketing must of course, be compliant with the law.
In addition to our advice on the central provisions of the Danish Marketing Act regarding the prohibition of misleading marketing and requirements for documentation, we also advise on the Danish Consumer Ombudsman's quick guide on environmental marketing. The guide outlines what you as a company must pay attention to when marketing products as being less harmful to the climate than other products. The purpose is to target misleading marketing of activities or products that are presented as being more environmentally friendly and sustainable than they are.
Therefore, it is important to keep in mind that all climate and environmental statements are information about actual conditions of the company, the production and/or the products. As a company, you must be able to substantiate all statements made.
