Legal advise about construction projects
Sustainable building and construction projects are a key part of the green transition, including Denmark’s ambition to reach 70% carbon reduction by 2030. In 2021, the Danish government signed a political agreement to promote sustainable construction, and as of 1 January 2023 new requirements for life cycle assessments and carbon thresholds for major construction projects came into force. Thresholds for carbon emissions will be tightened stepwise towards 2030 and will apply to all types of new buildings from 2025.
Employers, consultants, contractors and suppliers are facing high demands from both the public, the investors and the authorities. We advise all construction parties on ESG compliance and implementation in construction and infrastructure projects, for example through contracts for recycling of construction materials, energy efficiency in buildings, and the use of biofuels for machinery and equipment.
We also advise on compliance and implementation of sustainability in procurement processes/tendering processes for both private companies and public authorities; both in any pre-qualification and in the evaluation criteria. This also applies to municipal tenders of real estate.
The general focus on sustainability and the EU taxonomy has led to a significant increase in demand for certifications. We provide advice on the various sustainability certifications for new buildings, including DGNB and Svanemærket.
Finally, we handle disputes related to non-compliance with ESG requirements.
